Abstract

Taking China’s Patent Law as the research subject, this paper adopts secondary research and expert interviews to analyze its operation focusing on pharmaceutical and high-tech industries, supported by official statistical data and PEST analysis. The results show the patent system effectively stimulates research and development investment via market exclusivity and punitive damages, boosts industrial innovation and economic growth, and balances pharmaceutical innovation and public access to generic drugs. However, it suffers from low-quality idle patents, uneven regional enforcement, pharmaceutical patent evergreening, patent thickets, malicious litigation, and incomplete regulations for AI inventions. Targeted improvements are proposed, including optimized examination, differentiated punitive damages, overseas risk warning platforms, and supporting policies for SMEs. This study offers references for advancing high-quality intellectual property development.
